California Highway Patrol officer who shot driver of car being pursued by authorities was not entitled to qualified immunity in wrongful death action where officer had been assigned to sit in his patrol car parked on the road and never obtained permission to enter the pursuit; failed to communicate with any of the other units engaged in the chase, barging ahead of them, and twice using force without authorization by ramming his patrol car against the driver’s vehicle; and ultimately shot the driver without warning and without the need to defend himself or the other officers.
